Estate Litigation

Conflict often arises when one generation transfers wealth to another. Beneficiaries who want to protect their interests, or people who are left out of a will, need competent legal counsel to advise them.

Here are some of the questions that give rise to Estate Litigation:

  1. Did the deceased have capacity to make a Will?
  2. Was the Will signed and witnessed properly?
  3. Does any Statute provide protection to those excluded in the Will?
  4. Was the new Will executed under suspicious circumstances?
  5. Is the will unfair? A person's entitlement to support, their personal relationship with the deceased and the extent to which one assisted the deceased prior to their demise may also be relevant.

When dealing with conflict, clients require competent legal counsel to provide a realistic assessment and cost benefit analysis of their options. MacDermid Lamarsh has the lawyers whose experience and manner speaks to those needs.

Going to court in circumstances like these may or may not be the right thing to do.  For those considering this option, there is no replacement for hiring a competent solicitor whose own research, analysis and judgment should be canvassed prior to going to court.
